Receiving an eviction notice is frightening, but you have legal rights. An eviction must follow a specific legal process, and many times you can defend yourself successfully.

The legal eviction process

  • 1. Written notice — The landlord MUST give you a formal notice

  • 2. Cure period — Generally 3-30 days to resolve the problem

  • 3. Court lawsuit — If you do not resolve it, it must go to court

  • 4. Hearing — You have the right to appear and defend yourself

  • 5. Court order — ONLY a judge can order the eviction
